Host Guys provides global web hosting to many clients and we have a responsibility to provide each and every client with the best possible service. The following guidelines have been established to insure this intent is met.

Content:
All services provided by Host Guys may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secrets and other statutes. Host Guys is not responsible for any claims resulting from the use of our service.  

Note: Pornography and sex-related merchandising are prohibited on any Host Guys server. This includes sites that may infer sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to Host Guys servers or any other server on the internet. Links to such materials are prohibited. This also includes, but not limited to pirated software, illegally distributed MP3s, hacker programs/archives, and Warez sites. Host Guys will be the sole arbiter as to what constitutes a violation of these provisions.

Bandwidth Traffic Policies:
We are pleased to offer our standard hosting clients with a large amount of web site data traffic allowance per month - surpassing the web hosting industry standard for traffic allowance. Please note that over 90% of all web sites never even go above 2GIGS of data traffic per month even if a site is relatively popular. However, to maintain the integrity of our system, domains that go extremely beyond their traffic allowance will be automatically disabled without notice to protect current users on the system. Domains that may be susceptible to going over the traffic allowance usually house enormously large files (zips, ROMs, mp3s, graphic galleries) or domains that house multiple main web sites. Extra traffic bandwidth allowance may be purchased at discounted rates through our support center. Host Guys will make every effort to notify the user ahead of time before any extra charges are applied.

Chat Rooms and IRC:
We offer a variety of chat room programs.  As long as they do not degrade the performance of the system for others, they may be used at will. Furthermore, we currently DO NOT allow IRC or IRC bots to be operated on our servers.

Background running programs:
Host Guys does NOT allow programs to run continually in the background.

Commercial Advertising - Email:
Spamming, the sending of unsolicited email or posts, from ANY server is STRICTLY prohibited. Our servers may not be the source, intermediary, or destination address involved in the transmission of spam, flames, or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. Advertising sites on other servers which in turn contain links to a domain on our servers is prohibited. We consider spam any mass unsolicited message in the mediums of Newsgroups and Email. If you are found to have spammed, then we will immediately, without warning, disable your domain. We reserve the right to refuse or cancel service to known spammers. Furthermore, we consider the selling for bulk email software on a hosted domain a violation of this policy. As such, any violation will result in immediate deactivation of services without refund. Host Guys will be the sole arbiter as to what constitutes a violation of this provision.

Server Abuse:
Any attempts to undermine or cause harm to any Host Guys server or customer of Host Guys is strictly prohibited.

Host Guys is proud to offer a 30 day money-back guarantee.  If you sign up for a standard account and you are not completely satisfied within 30 days, we will refund the monthly charge. We do not refund InterNIC registration fees.

We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by Host Guys are resold. Thus, certain equipment, routing, software, and programming used by Host Guys are not directly owned or written by Host Guys. Moreover, Host Guys holds no responsibility for the use of our clients' accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to edit these policies without advance notice and reserve the right to remove any account without advanced notice for any reason Host Guys sees fit.
